Abstract
For the construction of China's independent legal knowledge system,it explores the evolution of the discourse on the right to aging in a broad historical and comparative perspective,it is of great theoretical significance to explain the generating logic of legal knowledge in the analysis of contradictory movements of system and culture,norms and values.Since modern times,the image of “ethical old age” in traditional China has been impacted and challenged as never before.The discourse of the right to aging in modern China,whether as a specific human right,a rights of a special group,or as a kind of response to social problems,has always been in a predicament in the knowledge system.The Communist Party of China adheres to the concept of “revolutionary old age” and the standards of benefits it contains,which is the discourse compounding and institutional innovation of the rights to aging as laborers,citizens,group members and universal life experiences,it creates the logic of coherent and integrated legal knowledge.Through the creative transformation and innovative development of excellent cultural tradition,moral rights can be proved and transformed into legal rights.
