Abstract
The legislation and practice of the leniency system of confessing guilt and punishment is setting off a systematic intellectual fission.Negotiated criminal responsibility has emerged from this, which indicates that the traditional theoretical system of criminal responsibility will usher in a new turn.The positive theory is based on the practice of prosecution and defense sentencing negotiation after voluntary confession and punishment.Negotiated criminal liability has shown a series of internal and external characteristics that are different from the past.Responsibility and punishment, the "procedural confirmation" of conviction activities, the elements of negotiated imputation, and the expansion of the content of sentencing negotiation have emerged.
